This contract is made on 04/27/2019 between Blue Mesa Review (hereinafter referred to as “the Publisher”) and Timothy Phillips (hereinafter referred to as “the Author”), whose address is:

The parties agree as follows:
The Author grants permission to include the artwork titled “Santa Fe Dream” (hereinafter referred to as “the Work”) in Blue Mesa Review ISSUE 39.
This use of the Work by the Publisher entails the assignment of First Rights, and specifically First Internet Use Rights, for publication in Blue Mesa Review ISSUE 39, online and in various subscription formats (including but not limited to e-mail, RSS feed, Kindle, and any other subscription format that may be available at the time of publication).
The Author understands and agrees that, after the date of publication, the Work will remain accessible online in Blue Mesa Review's archives at the Publisher's discretion.
It is understood and agreed by all parties that the Publisher may use this Work only as described above, and that all rights not expressly granted by this contract reside exclusively with the Author, including but not limited to electronic rights.
Reprint Rights and Credits
The Author grants to the Publisher the right to make future offers on non-exclusive reprint rights.
If the Publisher chooses to exercise this option, a separate agreement must be entered into for each use of the reprint rights.
The Author recognizes the right of the Publisher to be credited as the original publisher of the Work, if the Work should be reprinted elsewhere.
Warranties, Representations, and Indemnities
The Author represents and warrants that they are the sole author of the Work, that the Work is original and not previously published, in whole or in part, and that the Work does not, to the best of their knowledge, infringe any third party's copyright, trademark, or other proprietary rights.
The Author also represents and warrants, to the best of their knowledge, that the Work does not contain any libelous material, nor does it violate any third party's right of privacy or publicity.
